TERMS & CONDITIONS
(a) ‘Burning Sage’ is the trading name of Marika Thomson of 1 Brill Close, Marlow, Bucks, SL7 2RH.
(b) ‘The Client’ means the party entering into agreement with Burning Sage for teaching, treatments, consultancy, and/or other relevant services provided to the party named on the Registration and Waiver Form and/or Treatment Consultation Form.
(c) ‘Sessions’ means the teaching, treatment or consultancy sessions of variable frequency and duration as agreed between the Client and Burning Sage either on the Registration and Waiver Form, the Treatment Consultation Form, related documentation or otherwise.
(d) Wherever plural or singular terms are used within this document then such terms are intended to be mutually interchangeable; singular also implies plural where appropriate and plural also implies singular where appropriate.
2. Acceptance of Order
2.1 The Client’s signature on the Registration and Waiver Form and/or the Treatment Consultation Form will be constituted as confirming the Client’s total and unconditional acceptance of these terms and conditions. Burning Sage’s acceptance of the Client’s order denoted by the authorised signature on the Registration and Waiver Form and/or Treatment Consultation Form will create a contract between Burning Sage and the Client subject to the terms and conditions herein. No amendment will be valid unless agreed in writing by authorised parties of both Burning Sage and the Client.
2.2 In the event of a Client using Burning Sage’s services with or without the Registration and Waiver Form being signed and irrespective of any other contractual arrangement, the acceptance and attendance by such Client and/or their authorised agent on consultancy Sessions will form a legally binding contract between the Burning Sage and the Client subject to the terms and conditions herein and confirms the Client's total and unconditional acceptance of these terms and conditions.
2.3 Unless otherwise agreed in writing these terms shall prevail over any terms of business or purchase conditions proffered by the Client.
3.1 Burning Sage undertakes to provide the Sessions on the dates agreed except when external circumstances prevent this.
3.2 Burning Sage reserves the right to cancel a Session up to the start date of the Session. In the event of a Session being cancelled by Burning Sage, alternative dates will be proposed and agreed with the Client, or a full refund of monies paid will be made to the Client.
3.3 Burning Sage will be happy to advise the prospective Client on Session content. However, the Client shall take full and final responsibility for deciding on the suitability of a particular Session.
3.4 The fee covers Session time only. The fee does NOT include transportation or accommodation.
3.5 The Client undertakes to provide adequate facilities, as agreed by a representative of Burning Sage prior to any Session, for Sessions held on Client’s premises.
3.6 Sessions are valid only for the individual whose signature appears on the Registration and Waiver Form and/or Treatment Consultation Form.
3.7 All multiple Session packages are only valid for 1 individual and are non-transferable.
4. Cancellations and No Show
4.1 Cancellations made by a Client will be accepted up to 48 hours before the scheduled start of the specified session without incurring costs
4.2 Cancellations made by a Client between 48 and 24 hours prior to the scheduled start of a session may incur a cancellation fee of £25 at the sole discretion of Burning Sage.
4.3 Cancellations made by a Client less than 24 hours in advance of a Session, or if they do not turn up to a Session, may incur a full charge at the sole discretion of Burning Sage.
4.4 All cancellations need to be confirmed with the Burning Sage at which time a Session cancellation confirmation reference will be provided. This reference will need to be quoted in any further correspondence relating to this cancellation.
5.1 Clients may reschedule to an alternative Session time and date with the agreement of Burning Sage up to 24 hours prior to the start time of a Session without incurring costs provided the Session is not a previously rescheduled Session.
5.2 Clients rescheduling a previously rescheduled Session may incur a rescheduling charge of £10 at the sole discretion of Burning Sage.
5.3 Burning Sage reserves the right to reject any or all proposed Clients without reference to any other party and at the sole discretion of Burning Sage.
6.1 Burning Sage will indemnify the Client for direct physical injury or death arising out of the provision of the Session to the Client and solely attributable to the negligence of Burning Sage’s assigned representatives acting within the course of their provision of the session.
6.2 Except as stated in clause 6.1 above, Burning Sage shall not be liable for any special, indirect, incidental or consequential damages including but not limited to loss of profits or arising from loss of data or arising from or in connection with the provision of the Session to a Client.
6.3 The liability of Burning Sage for any breach of these terms and conditions shall be limited to refund to the Client of any Session fee paid minus reasonable expenses where deemed appropriate at the sole discretion of Burning Sage.
6.4 The Client shall indemnify and defend Burning Sage and its employees in respect of any claim by third parties that are occasioned by or arise from any Burning Sage performance or non-performance pursuant to the instructions of the Client or its authorised representative.
7.1 Prices for the provision of teaching, treatments and/or consultancy are payable on booking a Session. No services will be provided until payment in full has been made.
7.2 Preferred payment options accepted by Burning Sage are bank transfer and cash. Other options are accepted at the discretion of Burning Sage.
9.1 The law governing this contract shall be English Law and, the parties submit to the exclusive jurisdiction of the English Courts.
10.1 Neither party shall be liable for total or partial failure to perform its obligations hereunder during any period in which its performance is prevented or hindered by circumstances beyond its reasonable control.
10.2 No failure, delay, relaxation or indulgence on the part of Burning Sage in exercising any power or right in this Agreement shall operate as a waiver of such power or right nor shall any single or partial exercise of any such power or right preclude any other or further exercise thereof or the exercise of any other power or right.
10.3 Any notice given under this Agreement by either party to the other must be in writing and must be received by the other party a minimum of 7 working days before it is to take effect. Notices shall be sent to the addresses of the parties set out herein or to any other address notified in writing by either party to the other for the purpose of receiving notices.
